Terms of Service

By accessing or using any application or service provided by Power Manufaktur GmbH, you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use our services.

Power Manufaktur provides a suite of integrated solutions – Power IMS, Power Copilot, and Power Vibecoding – built on Microsoft Cloud technologies. The solutions are installed and operated within each customer's Microsoft 365 environment. Data remains within the customer's infrastructure.

To use our services, you must:

• Have a valid Microsoft 365 subscription
• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Be at least 18 years old or have parental consent

Our services are offered under various subscription plans. Payments are processed through Microsoft AppSource or direct invoicing. All fees are non-refundable except as required by law.

You agree not to use our services to:

• Violate any applicable laws or regulations
• Infringe upon intellectual property rights
• Transmit malware, viruses, or harmful code
• Attempt unauthorized access to our systems
• Interfere with the proper functioning of our services

All content, features, and functionality of our services are owned by Power Manufaktur and are protected by international copyright, trademark, and other intellectual property laws. You retain ownership of any content you create using our services, but grant us a license to host and display that content as necessary to provide our services.

We commit to 99.9% uptime for our paid services, excluding scheduled maintenance. Enterprise customers may have custom SLA terms.

Either party may terminate this agreement at any time. We may terminate or suspend your access immediately for conduct that violates these terms or is harmful to other users or our services.

To the maximum extent permitted by law, Power Manufaktur shall not be liable for any indirect, incidental, special, consequential, or punitive damages. Our total liability shall not exceed the amount paid by you for our services in the twelve months preceding the claim.

You agree to indemnify and hold harmless Power Manufaktur and its affiliates from any claims, damages, or expenses arising from your use of our services, your violation of these terms, or your violation of any rights of a third party.

We reserve the right to modify these terms at any time. We will notify you of any material changes via email or through our services. Your continued use of our services after such modifications constitutes acceptance of the updated terms.

These terms shall be governed by the laws of Switzerland. Any disputes arising from these terms shall be resolved in the courts of Lucerne, Switzerland.
